Original or Copy? Now LIDL Joins the Look Alike Brigade!

What do you think Fair or Unfair competition?

ACID Ambassador Rob Law MD of Magmatic, t/a Trunki, is no stranger to finding lookalikes of their world famous Trunki Designs all over the place and now The Sun has published a recent article showing LIDL are joining the brigade!   Is “taking inspiration” just a sanitised word for blatant copying?

Many will remember the Supreme Court judgment which many said was calamitous and which plunged the design community into dismay with many commenting, “Well what is the point of registering a design, spending hundreds of thousands of pounds trying to take legal action and then losing to PMS who even said they were inspired by the award winning Trunki suitcase which they continue to sell.”  What do you think?

If the Trunki v PMS debacles weren’t enough, Trunki are now facing look alike issues with Highlander who are refusing to remove the lookalike product which is remarkably similar to their original PaddlePak Water-Resistant children’s backpack design.

The UK Government has said that intellectual property theft is a crime just as significant as physical theft. But where is the justice? Is this fair or unfair competition for others to free ride on the back of Trunki’s original design?

If someone stole 1000 diamond rings they could end up with a criminal record. Or if they did this consistently they could probably have a custodial sentence. But, somehow, stealing designs and the potential livelihood of a design-led business seems OK? That can’t be right!  What do you think?
