The EU Commission is holding a public consultation on the evaluation of EU legislation on Design Protection. Have you tried taking action based on UK or EU legislation or did you find the process hard to access or difficult to use? Did you have a successful result and achieve what you needed?
What is the Commission’s Target Audience ?
- All sectors of industry, businesses, designers who own or create designs including SME’s and individuals
- Bodies and associations representing economic sectors to include design and creative industries, SME’s individual designers, design right owners, legal practitioners and professional representatives in the area of design law
- National Intellectual Property offices of EU member states
- The Judiciary
- General Public, consumer organisations, civil rights organisations
Why are they consulting?
- To gather stakeholder evidence and view to establish the degree to which legislation works as intended and is fit for purpose.
- Existing EU legislation dates back to the 1998 Design Directive and 2002 Community Design Regulation which to date has not been evaluated.
- The aim is to collect and assess data received from stakeholders who have experience of the design protection systems at both National and EU level.
This will help the Commission to assess the need for improvement, modernisation and further harmonisation of the original acts. This may lead to an impact assessment and legislative review.
ACID will register on the EU’s Transparency Register prior to completing the full questionnaire as a Trade Association but we need ACID Members to share their personal experiences of existing EU legislation for design protection.
To Respond to the Questionnaire as an individual/business owner

- After registering your details and receiving an email with a log in link you will be directed to the online questionnaire.
- You have the option of being anonymous or public when the consultation is published
- The questions are collated depending on your status i.e. designer, trade association, legal body etc.
- There are only 14 or so questions in the individual survey, with a couple of options to expand upon your answer in free text boxes.
The closing date for submissions has recently been extended to 15th April 2019 so please take the opportunity to share your experiences of design legislation.
